The convictions, handed down by the Criminal Court on Ratchadaphisek Road, stem from a transnational criminal organization that exploited Thai women for surrogacy and egg donation, circumventing Thailand’s strict regulations on commercial surrogacy.
Illegal Surrogacy Network Dismantled
The case originated from an investigation launched in 2020 by the Anti-Human Trafficking Division. Authorities uncovered a sophisticated surrogacy network allegedly orchestrated by Chinese national Ran Zhao. This syndicate is accused of recruiting Thai women, promising them significant financial compensation, to serve as surrogate mothers or to sell their eggs for in-vitro fertilization (IVF) procedures. The operation aimed to bypass Thailand’s legal prohibition against commercial surrogacy by conducting key stages of the process in neighboring countries.
Investigators detailed how the recruited Thai women were typically paid between 400,000 and 450,000 baht. To circumvent Thai law, they were transported to Laos and Cambodia for embryo implantation. Following successful implantation, they would return to Thailand for prenatal care before traveling again, often shortly before giving birth, to destinations like China.
Key Roles and Legal Violations
Central to the prosecution’s case was the alleged role of Lt Col Dr. Chanin Asawataret. The court identified him as a key medical professional who prepared sperm samples and performed the crucial embryo implantation procedures. This medical expertise was allegedly used to facilitate the illegal surrogacy arrangements.
In addition to medical personnel, a Thai female broker was apprehended. This individual reportedly managed the financial aspects of the operation, with investigators tracing over 70 international money transfers linked to the network’s activities. These financial trails provided critical evidence of the operation’s scale and cross-border nature.
Court’s Findings on Medical Professionals and Brokers
The court’s ruling highlighted the awareness of the medical professionals involved. It stated that four obstetricians and gynecologists, including Dr. Chanin, were fully aware that commercial surrogacy and the sale of human eggs contravened both Thai law and established medical ethics. Despite this knowledge, they proceeded with the procedures abroad, specifically to evade legal repercussions within Thailand.
Furthermore, the court found that four individuals acting as brokers played pivotal roles in the scheme. Their actions were deemed to have negatively impacted the rights and welfare of the children born through this process. The court emphasized that these children were potentially separated from their biological families and exposed to risks of long-term psychological harm due to the clandestine nature of their conception and birth.
Sentencing and Acquittals
The court convicted the doctors and brokers on multiple charges related to their participation in the illegal surrogacy ring. While their sentences were reduced by one-quarter due to their cooperation with authorities during the proceedings, the court imposed significant prison terms, acknowledging the gravity of the offenses.

- Lt Col Dr. Chanin Asawataret: Sentenced to 15 years in prison, identified by the court as the ringleader among the medical staff.

Two other defendants in this specific case were acquitted by the court, meaning the prosecution did not establish their guilt beyond a reasonable doubt.
Related Case of Masterminds
This prosecution is distinct from the earlier case involving the alleged masterminds of the operation. Ran Zhao and three associates had previously pleaded guilty to charges of operating the surrogacy ring. In that proceeding, they initially received sentences of 150 years each, which were subsequently reduced to 75 years due to their guilty pleas and cooperation.
The convictions underscore the legal risks and ethical concerns associated with commercial surrogacy, particularly when conducted outside established legal frameworks.
